These Terms and Conditions govern all transportation services provided by Vizcaino Transport. By requesting, booking, accepting, or using our transportation services, the customer, shipper, broker, consignee, or any authorized representative agrees to the terms below.
1. Services Provided
Vizcaino Transport provides freight transportation services, primarily using dry van trucks. Our services may include pickup, transportation, and delivery of general freight as agreed in writing through a rate confirmation, bill of lading, dispatch confirmation, quote, email, or other written agreement.
Unless agreed in writing, Vizcaino Transport does not provide refrigerated, temperature-controlled, hazardous materials, household goods moving, oversized, tanker, livestock, passenger, or specialized freight services.
2. Acceptance of Terms
By booking a load or allowing Vizcaino Transport to pick up freight, the customer confirms that they have read, understood, and accepted these Terms and Conditions.
If there is a separate signed agreement, broker-carrier agreement, rate confirmation, bill of lading, or written contract, that document may control specific load details. These Terms and Conditions apply unless they conflict with a signed written agreement.
3. Quotes and Rates
All quotes are based on the information provided by the customer, shipper, broker, or their representative. Rates may be based on mileage, equipment type, pickup and delivery locations, weight, commodity, appointment times, urgency, and other shipment details.
A quote is not final until accepted in writing by Vizcaino Transport. Any incorrect or missing shipment information may result in rate changes or additional charges.
Additional charges may apply for, including but not limited to:
- Detention
- Layover
- Truck ordered not used
- Extra stops
- Driver assist
- Lumper fees
- Re-delivery
- Storage
- Tolls
- Scale tickets
- Overweight issues
- Appointment delays
- After-hours pickup or delivery
- Route changes
- Cancelled loads
- Waiting time caused by shipper, consignee, broker, or customer
4. Payment Terms
Unless otherwise agreed in writing, payment is due according to the payment terms stated on the invoice, rate confirmation, or signed agreement.
If no payment term is stated, payment is due within 30 days from the invoice date.
The customer agrees to pay all approved freight charges, accessorial charges, detention, layover, lumper fees, tolls, and any other valid charges related to the shipment.
Late payments may be subject to late fees, collection costs, attorney fees, and any other remedies allowed by law.
Vizcaino Transport reserves the right to pause or refuse future services if payments are overdue.
5. Customer and Shipper Responsibilities
The customer, shipper, broker, or their representative is responsible for providing accurate shipment information, including:
- Pickup address
- Delivery address
- Contact details
- Commodity description
- Weight
- Piece count
- Packaging type
- Appointment times
- Special instructions
- Freight value, if applicable
- Any handling requirements
The shipper is responsible for properly packaging, labeling, loading, blocking, bracing, and securing the freight unless Vizcaino Transport agrees otherwise in writing.
The customer must ensure that freight is legal, safe, properly documented, and suitable for dry van transportation.
Vizcaino Transport is not responsible for loss, damage, fines, claims, or delays caused by incorrect shipment details, poor packaging, improper loading, overweight freight, inaccurate bills of lading, or shipper/consignee mistakes.
6. Prohibited Freight
Unless specifically agreed in writing before pickup, Vizcaino Transport does not accept:
- Hazardous materials
- Illegal goods
- Firearms or ammunition
- Alcohol, tobacco, cannabis, or controlled substances
- Live animals
- Human remains
- Household goods or personal effects
- Perishable or temperature-sensitive freight
- High-value cargo
- Cash, jewelry, precious metals, or negotiable instruments
- Explosives or flammable materials
- Freight requiring special permits
- Any cargo not suitable for dry van transportation
If prohibited freight is loaded without written approval, the customer accepts full responsibility for all claims, damages, penalties, delays, and costs.
7. Equipment
Vizcaino Transport primarily uses dry van trailers. The customer must confirm that the freight is suitable for dry van equipment.
Vizcaino Transport is not responsible for damage to freight that required temperature control, special handling, liftgate service, flatbed service, tanker service, or any other specialized equipment unless such service was agreed in writing before pickup.
8. Pickup and Delivery
Vizcaino Transport will make reasonable efforts to meet scheduled pickup and delivery appointments. However, pickup and delivery times are estimates unless specifically guaranteed in writing.
Delays may occur due to traffic, weather, road closures, mechanical issues, inspections, shipper delays, consignee delays, accidents, force majeure events, or other circumstances beyond our reasonable control.
Vizcaino Transport is not liable for delay-related losses unless such liability is required by law or agreed in writing.
9. Detention and Waiting Time
Detention may apply when the driver is delayed at pickup or delivery beyond the free time allowed in the rate confirmation or written agreement.
If no free time is stated, the standard free time is:
- 2 hours free time at pickup
- 2 hours free time at delivery
After free time expires, detention charges may apply at the agreed rate. If no rate is agreed, detention will be billed at a reasonable industry rate.
The customer is responsible for detention caused by shipper, consignee, broker, warehouse, appointment issues, paperwork delays, loading delays, unloading delays, or other delays outside the control of Vizcaino Transport.
10. Layover
Layover charges may apply when the driver is held overnight or cannot complete pickup or delivery due to delays outside the control of Vizcaino Transport.
Layover charges will be billed according to the rate confirmation or written agreement. If no amount is stated, layover will be billed at a reasonable rate.
11. Truck Ordered Not Used
If a truck is dispatched and the load is cancelled, unavailable, not ready, double-booked, or otherwise not provided, a Truck Ordered Not Used charge may apply.
This charge covers time, fuel, lost opportunity, and operational costs.
12. Bill of Lading
The bill of lading is an important shipping document and may act as evidence of the shipment, freight condition, piece count, pickup, delivery, and other shipment details.
The shipper must ensure that the bill of lading is accurate. The driver’s signature on a bill of lading does not confirm hidden condition, exact weight, count, contents, value, or quality of freight unless the driver had a reasonable opportunity to inspect and verify it.
Any special instructions must be clearly written on the bill of lading and approved before pickup.
13. Cargo Claims
All cargo claims must be submitted in writing. A valid claim must include enough information to identify the shipment, state the nature of the loss or damage, and request a specific or determinable amount of money.
Claims should include:
- Load number
- Bill of lading
- Delivery receipt
- Photos of damage
- Commercial invoice
- Packing list
- Inspection report, if available
- Proof of cargo value
- Explanation of the claim amount
For interstate shipments, cargo claims must be filed within the time allowed by applicable law, bill of lading, or written agreement. Vizcaino Transport will not accept claim periods shorter than those allowed by federal law.
Filing a claim does not automatically mean the claim is accepted. Vizcaino Transport reserves the right to investigate, approve, deny, or settle any claim according to applicable law and the facts of the shipment.
14. Limitations of Liability
Vizcaino Transport’s liability, if any, is limited to actual physical loss or damage to freight while the freight is in our care, custody, and control, subject to applicable law and written agreements.
Vizcaino Transport is not liable for:
- Improper packaging
- Improper loading by shipper
- Improper unloading by consignee
- Hidden damage
- Inherent vice of the goods
- Acts of God
- Weather-related delays
- Government action
- Road closures
- Accidents not caused by Vizcaino Transport
- Shipper or consignee negligence
- Incorrect freight description
- Overweight loads
- Temperature-sensitive goods placed in dry van equipment
- Consequential damages
- Lost profits
- Business interruption
- Market loss
- Penalties charged by third parties
Any limitation of liability must comply with applicable law and any written agreement between the parties.
15. Freight Condition and Inspection
The consignee must inspect freight at delivery before signing the delivery receipt.
Any visible damage, shortage, or issue should be clearly written on the delivery receipt at the time of delivery. Signing the delivery receipt without noting damage or shortage may be treated as evidence that the freight was delivered in good condition, unless hidden damage is later proven.
Hidden or concealed damage should be reported as soon as possible with supporting evidence.
16. Weight and Legal Compliance
The customer and shipper are responsible for providing accurate freight weight and ensuring the shipment is legal for transport.
If freight is overweight, improperly loaded, or causes legal violations, the customer is responsible for all related costs, including fines, rework, reloading, scaling, delays, permits, and additional transportation charges.
Vizcaino Transport reserves the right to refuse or stop transportation of any shipment that appears unsafe, illegal, overweight, improperly loaded, or unsuitable for transport.
17. Loading and Unloading
Unless agreed in writing, Vizcaino Transport drivers are not responsible for loading or unloading freight.
Shippers and consignees must provide safe and suitable facilities, equipment, docks, forklifts, staff, and access for loading and unloading.
Any driver assist, hand unload, pallet jack work, inside delivery, or special handling must be agreed in writing and may result in additional charges.
18. Access to Locations
The customer is responsible for ensuring that pickup and delivery locations are safe, legal, and accessible for commercial trucks.
If a location is unsafe, restricted, inaccessible, or unsuitable for dry van equipment, additional charges may apply. Vizcaino Transport may refuse entry or request an alternate location.
19. Insurance
Vizcaino Transport maintains insurance coverage as required by applicable law and business operations.
Insurance coverage does not create automatic liability for every claim. All claims are subject to investigation, policy terms, exclusions, documentation, and applicable law.
Customers who require additional insurance, declared value coverage, or special coverage must request and receive written approval before pickup.
20. Force Majeure
Vizcaino Transport is not responsible for failure or delay caused by events beyond reasonable control, including but not limited to:
- Severe weather
- Natural disasters
- Road closures
- Accidents
- Mechanical breakdowns
- Government action
- Labor strikes
- War or civil unrest
- Fires
- Floods
- Pandemics
- Cyberattacks
- Fuel shortages
- Acts of God
21. Cancellation
Loads cancelled after dispatch may be subject to cancellation charges, including Truck Ordered Not Used, deadhead miles, fuel, driver time, and other reasonable costs.
Cancellation charges may vary depending on how far the truck has traveled, time lost, and whether another load opportunity was missed.
22. Communication
The customer must provide accurate contact information and remain available for pickup, transit, delivery, appointment, and issue-related communication.
Vizcaino Transport may communicate by phone, email, SMS, or other reasonable business methods.
Failure to respond in a timely manner may cause delays, additional charges, or service issues.
23. No Guarantee of Specific Results
Vizcaino Transport will use reasonable care and effort to provide professional transportation services. However, we do not guarantee specific delivery times, freight outcomes, costs, or third-party actions unless expressly agreed in writing.
24. Indemnification
The customer agrees to defend, indemnify, and hold harmless Vizcaino Transport, its owners, employees, drivers, contractors, and representatives from claims, losses, damages, penalties, fines, expenses, and attorney fees caused by:
- Customer’s breach of these Terms
- Incorrect shipment information
- Illegal or prohibited freight
- Improper packaging
- Improper loading or unloading
- Overweight freight
- Unsafe locations
- Third-party claims caused by customer, shipper, consignee, or broker actions
25. Independent Contractor Status
Vizcaino Transport operates as an independent carrier. Nothing in these Terms creates a partnership, joint venture, agency, employer-employee relationship, or exclusive business relationship between the parties.
26. Non-Solicitation
Unless otherwise agreed in writing, customers, brokers, shippers, and consignees shall not directly solicit, hire, or contract with Vizcaino Transport drivers, employees, or contractors for separate transportation services outside of Vizcaino Transport.
This section applies to the extent allowed by applicable law.
27. Website Use
If these Terms are published on the Vizcaino Transport website, visitors agree not to misuse the website, submit false information, attempt unauthorized access, copy content without permission, or use the website for unlawful purposes.
Website content is provided for general business information only and may be updated at any time.
28. Privacy
Vizcaino Transport may collect customer information such as names, phone numbers, emails, company information, pickup and delivery details, and shipment information for business purposes.
We do not sell customer information. Information may be shared only when necessary to provide transportation services, process payments, comply with law, handle claims, or manage business operations.
29. Dispute Resolution
The parties agree to first attempt to resolve disputes through good-faith communication.
If a dispute cannot be resolved, it may be handled according to the governing law and venue stated in the signed agreement, rate confirmation, bill of lading, or applicable law.
If no venue is stated, disputes shall be handled in the state and county where Vizcaino Transport is legally registered, unless applicable law requires otherwise.
30. Governing Law
These Terms and Conditions are governed by applicable federal transportation law and, where not preempted, the laws of the state where Vizcaino Transport is legally registered.
31. Changes to Terms
Vizcaino Transport may update these Terms and Conditions at any time. Updated terms will apply to future shipments, quotes, bookings, and services after they are posted or provided.
32. Severability
If any part of these Terms is found invalid or unenforceable, the remaining sections will continue to apply.
33. Entire Agreement
These Terms, together with any signed agreement, rate confirmation, bill of lading, invoice, or written communication, form the agreement between Vizcaino Transport and the customer for transportation services.
